"Having worked for more than 15 years as lawyer in China and Vietnam my family and I decided to go back to Germany and to support and consult European businesses and individuals with my experience."
Dr. Martin Seybold, LL.M. Eur., German Lawyer
After my legal studies in Kiel, Strasbourg (France) and Munich, and my legal traineeship in Southern Bavaria I started my legal career in 2002 as Researcher for Prof. Voigt at the University of the Federal Armed Forces in Neubiberg / Munich, and consulting the German Ministry of Defence in matters regarding the deployment of the German armed forces to abroad.
After that I was working for 2 years as In-house Counsel for the renowned Fraunhofer Gesellschaft. There my work focused on the legal structuring and set-up of Fraunhofer “Spin-Offs”, financing rounds with Venture Capital Investors, and the legal structuring of company shares sales and transactions.
End of 2004 I decided to give up my job in Germany to move to Beijing / China for an indefinite time, and to set up my own legal consultancy firm in Beijing. During my legal traineeship in 2001 I had already been in Beijing, while working for the Economic Department, Trade Promotion Office, at the German Embassy in Beijing. China was at that time fascinating and quite different from today. There was this certain atmosphere of a new beginning – everyone wanted to forget about the hardship of the Cultural Revolution, and leave this time behind. China at that time seemed to be a land of unlimited business opportinities, and really each foreigner was warmly welcome in this booming country.
In 2013 I took over the Head of the legal section of the Beijing subsidiary of a well known German business consulting firm. As from spring 2013 I was responsible for the legal section in Beijing. In January 2015 I became Head of Office of the entire Beijing subsidiary, responsible for around 20 lawyers, tax and financial advisors and assistants. In 2016 I became Managing Partner for the Beijing Office, was “Registered Foreign Lawyer”’ in China and official Representative of the Foreign Law Firm Representative Office in Guangzhou and, at a later stage, also Co-Head of the legal section of the Shanghai Subsidiary.
During the Civid-19 lock down in China beginning of 2020 I worked for 6 months as partner in the Vietnam subsidiaries in Ho Chi Minh City and Hanoi, consulting and supporting foreign invested companies and foreign Investors in the legal fields of foreign investments in Vietnam, Vietnamese Company Law and Contract Law, Real Estate Law and Labour Law.
I am fluent in spoken and written Chinese, with the abiity to read Chinese contracts and legal texts, and to write Chinese texts on my own.
My legal focus and specialisations are:
- Drafting, reviewing and negotiating of business contracts of all kinds,
- International contract law,
- German and international commercial and distribution law,
- German and international company law,
- Transactions, share deals, asset deals, national and international mergers and restructuring
A matter that is very important to me personally as well as my legal practice is international dispute resolution:
- Litigation in civil lawsuits at German and foreign courts, and
- International Arbitration, with emphasis on China and the ASEAN region.
In all those legal fields I can look back on more than 15 years of practical experience.
I am listed arbitrator at the Shenzhen Court of International Arbitration (SCIA).
